1. Acceptance of terms

By accessing or using DeepCutsArchive (“the Site”), including the DeepCutsArchive Clipper browser extension (“the Extension”), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Site or Extension.

2. Description of service

DeepCutsArchive is a curated archive that indexes and organises rare, behind-the-scenes musician footage. We do not host video files. All video content is embedded from third-party platforms (YouTube, TikTok, Facebook, Instagram) and remains the property of its original creators and rights holders. The Site provides metadata, curation, search, and discovery features around this embedded content.

3. User accounts

You may browse the archive without an account. Creating an account allows you to submit clips, save favourites, track your contributions, and appear on contributor leaderboards (if your profile is set to public).

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use of your account.

We reserve the right to suspend or terminate accounts that violate these terms.

4. User submissions

4.1 What you may submit

You may submit links to videos hosted on supported third-party platforms that feature rare, behind-the-scenes, or historically significant musician footage. Submissions may be made via the Site or the Extension.

4.2 Review and approval

All submissions are subject to review. We reserve the right to approve, reject, or remove any submission at our sole discretion. We aim to keep the archive focused on genuinely rare and interesting footage — official music videos, mainstream concert recordings, and promotional content are generally not accepted.

4.3 Your representations

By submitting a clip, you represent that:

• The video is hosted on a third-party platform and is publicly accessible at the URL you provide
• You are not uploading, hosting, or transferring any copyrighted material to us — you are only providing a link
• Any descriptive text, title, or artist information you provide is accurate to the best of your knowledge
• Your submission does not contain spam, malicious links, or misleading information

4.4 Attribution

If your submission is approved and you have a public profile, you may be credited as a contributor. You can control your visibility through your profile settings. Anonymous submissions receive no public attribution.

5. Intellectual property and copyright

5.1 Third-party content

All video content displayed on DeepCutsArchive is embedded from third-party platforms and remains the intellectual property of its original creators, rights holders, and/or the hosting platform. DeepCutsArchive does not claim ownership of any embedded video content.

5.2 DMCA and takedown requests

If you are a rights holder and believe that content indexed on DeepCutsArchive infringes your copyright, please contact us at copyright@deepcutsarchive.com with:

• A description of the copyrighted work you believe is being infringed
• The URL on our site where the content appears
• Your contact information
• A statement that you have a good faith belief the use is not authorised by the copyright owner

We will promptly remove the indexed reference upon receiving a valid takedown request. Note that since we embed rather than host the content, we may also direct you to the hosting platform where the original file resides.

5.3 Site content

The DeepCutsArchive name, logo, site design, curation, metadata, descriptions, and original written content are the property of DeepCutsArchive. You may not reproduce, distribute, or create derivative works from this material without our written permission.

6. Chrome extension

The DeepCutsArchive Clipper extension is provided as a convenience for submitting clips. By installing the Extension, you agree that:

• The Extension accesses only the active tabwhen you interact with it — it does not monitor your browsing activity
• Login credentials and authentication tokens are stored locally in your browser's sync storage
• The Extension extracts page metadata (video title, channel name) only from supported platforms (YouTube, Facebook, TikTok, Instagram) and only when you actively use it
• You are responsible for keeping your browser and extension up to date

7. Acceptable use

You agree not to:

• Use the Site to upload, share, or link to content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Submit links to content that you know to be infringing, pirated, or illegally distributed
• Attempt to gain unauthorised access to the Site, other user accounts, or our systems
• Use automated tools, scrapers, or bots to access the Site in a manner that exceeds reasonable use or places undue burden on our infrastructure
• Impersonate another person or misrepresent your affiliation with any entity
• Use the Site for any commercial purpose without our prior written consent
• Circumvent, disable, or interfere with any security features of the Site

8. Sharing and social features

The Site provides share buttons for various social platforms. When you use these buttons, you will be directed to the respective platform to complete the share. We record that a share occurred (platform and clip) for aggregate statistics. Your interaction with the third-party platform is governed by that platform's own terms and privacy policy.

9. Third-party links and sponsors

The Site contains links to third-party websites, including our sponsor GigFriend (gig-friend.com) and the video platforms from which content is embedded. We are not responsible for the content, privacy practices, or terms of any third-party sites. Visiting third-party links is at your own risk.

10. Disclaimers

The Site is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied.

We do not warrant that:

• The Site will be uninterrupted, error-free, or free of viruses or other harmful components
• Embedded videos will remain available — third-party platforms may remove content at any time
• The metadata, dates, artist attributions, or descriptions associated with clips are accurate or complete
• The Site will be available in your jurisdiction or comply with local regulations in all territories

11. Limitation of liability

To the fullest extent permitted by law, DeepCutsArchive and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Site, including but not limited to loss of data, loss of goodwill, or any damages resulting from third-party content accessed through the Site.

12. Indemnification

You agree to indemnify and hold harmless DeepCutsArchive and its operator from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Site, your submissions, your violation of these terms, or your violation of any third-party rights.

13. Modifications to service and terms

We reserve the right to modify, suspend, or discontinue the Site (or any part of it) at any time without notice. We may also update these terms from time to time. Changes will be posted on this page with an updated date. Your continued use of the Site after changes are posted constitutes acceptance of the updated terms.

14. Governing law

These terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to conflict of law principles. Any disputes arising from these terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.
